Copyright & DMCA Policy

Last updated: September 2026 – first draft, subject to counsel review

1. Our Policy

Xipoli respects the intellectual property rights of others and expects performers and viewers to do the same. You must not broadcast, upload, or otherwise transmit copyrighted music, film, television content, or other protected material through the Platform without a valid license or explicit permission from the rights holder. This includes background music, DJ sets using unlicensed recordings, and retransmissions of broadcast content — see Section 4 of our Terms of Service for the underlying representations every performer makes about the content they broadcast.

We respond to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act (“DMCA”), 17 U.S.C. § 512.

2. Designated Agent

Notices of claimed copyright infringement should be sent to our designated agent:

DMCA Agent, Xipoli
1220 Farley Ct N
Arnold, MD 21012
[PHONE NUMBER — TO BE COMPLETED]
dmca@xipoli.com

We have not yet registered this agent with the U.S. Copyright Office's DMCA Designated Agent Directory; we intend to. Until then, please send notices to the address or email above.

3. Filing a Takedown Notice

To be effective, a notification of claimed infringement must be in writing and include substantially the following:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  2. Identification of the copyrighted work claimed to have been infringed.
  3. Identification of the material claimed to be infringing and information reasonably sufficient to let us locate it (a stream, clip, or archive URL is ideal).
  4. Your contact information — name, address, telephone number, and email address.
  5. A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
  6. A statement, made under penalty of perjury, that the above information is accurate and that you are authorized to act on behalf of the copyright owner.

A notice missing any of these elements may not be actionable under the DMCA, and we may be unable to process it. Upon receiving a compliant notice, we will remove or disable access to the identified material, and take reasonable steps to notify the person who posted it.

4. Counter-Notification

If your content was removed and you believe this was a mistake or misidentification, you may submit a counter-notification to our designated agent. To be effective, it must include:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed and its location on the Platform before removal.
  3. A statement, under penalty of perjury, that you have a good faith belief the material was removed as a result of mistake or misidentification.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court in your district (or, if outside the U.S., any district in which Xipoli may be found), and that you will accept service of process from the person who filed the original notice or their agent.

If we receive a valid counter-notification, we will forward it to the person who filed the original claim. Unless that person notifies us within 10 business days that they have filed a court action seeking to restrain you from continuing the allegedly infringing activity, we will restore the removed material between 10 and 14 business days after receiving the counter-notification.

5. Repeat Infringer Policy

Xipoli will terminate, in appropriate circumstances, the accounts of users who are determined to be repeat infringers. We keep an internal record of copyright complaints against an account, independent of whether the specific content named in a notice is later removed, unpublished, or deleted — so that a pattern of infringement remains visible even after any one piece of infringing content is gone. We don't commit here to a fixed formula (like an automatic three-strikes rule); instead, each account with more than one substantiated notice against it is individually reviewed, weighing factors like the number and recency of notices, whether the same work or rights holder recurs, and whether any counter-notifications were filed and upheld.

6. Standard Technical Measures

We accommodate, and do not interfere with, standard technical measures used by copyright owners to identify or protect their works, to the extent required by 17 U.S.C. § 512(i). We have no general obligation to monitor the Platform for infringing content, and do not do so beyond the moderation described in our Terms of Service.

7. Questions

This policy is a first-pass draft, written to accurately reflect where we stand rather than to be complete on day one — it will keep changing as the Platform does. Questions that aren't a copyright notice or counter-notice should go to our contact page instead of the DMCA agent above.
